Defense Attorney Daniel Kaminsky, in a statement issued after the hearing, blasted authorities for conducting a biased and improper investigation.
"Not only do authorities have no idea who actually killed Lara Plamann, they intentionally avoided investigating material evidence that exonerated the Sivenys," Kaminsky said.
He pointed to evidence that Kandi Siveny's cell phone was in Minnesota at the time of the shooting. The phone received numerous calls. He said investigators avoided asking those callers whether they had talked to Kandi. He said his investigator asked those questions and learned Kandi Siveny hadn't left Minnesota.
Kaminsky also took issue with payments investigators made to witnesses for food and cigarettes that weren't disclosed in reports, and destruction of maps drawn by witnesses.
Kaminsky said authorities failed to confirm the alibi of a person who'd been seen in a pushing match with Plamann on the afternoon of her murder.
